Resident screening is an essential function of rental housing operations. Owners and operators develop screening policies and procedures to mitigate risk to their communities, their residents and employees and, importantly, utilize these rules to ensure equal housing opportunity and objective decision-making in the application process. Renters’ rights advocates continue to see these policies as barriers for vulnerable populations to access quality, affordable housing. The National Apartment Association (NAA) continues to see support for legislation that restricts housing providers’ ability to evaluate the criminal and credit history and more recently, a push to restrict access to eviction records, especially those that occurred during the pandemic. These regulations have unintended consequences for the renters they are intended to help and could compromise the viability of rental housing at a time when we desperately need more housing options, not fewer.
